Dispute Resolution - YOU WAIVE YOUR RIGHT TO JURY TRIAL AND YOU WAIVE YOUR RIGHT TO LITIGATE ANY CLAIM IN COURT AND CLAIM BROUGHT AS A CLASS ACTION. Any dispute which cannot be settled by reasonable discussion, will be resolved by arbitration in Lane County, Oregon. Arbitration shall be conducted in accordance with the then-effective arbitration rules of Arbitration Service of Portland, Inc., unless the parties by agreement adopt other rules of procedure. Any judgment upon the award rendered in such arbitration may be entered in any court having jurisdiction. Each party shall bear its own expenses and attorney fees related to the arbitration and one half of the arbitrator’s fees and expenses. In any proceeding to enforce or interpret the TOS, the prevailing party will be entitled to recover from the losing party reasonable attorney fees, costs, and expenses incurred by the prevailing party before and at any trial, arbitration, bankruptcy, or other proceeding, and in any appeal or review.

Miscellaneous – The TOS will be modified when we post updated TOS on the website. The TOS is the entire agreement of the parties. We have made no promises, terms, conditions, or obligations other than those contained in the TOS. The TOS will supersede all prior communications, representations, and agreements, oral or written, of the parties. The TOS will not be construed against the drafting party. The invalidity of any term or provision of the TOS will not affect the validity of any other provision. A printed version of the TOS shall be admissible proceedings based upon or relating to the TOS to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
